HALPERN GALLERIES OPEN CALL
Terms and Conditions
These terms and conditions (the “Terms”), apply to all participants in Halpern Galleries Open Calls. Your (the “artist/s”) participation in Open Calls and resulting exhibition indicates your agreement to these Terms. “Halpern Galleries” refers to The Halpern Gallery, Chatham and Halpern Pop, Rochester. Halpern Galleries are part of Nucleus Arts.
Participant’s Agreement
The artist/s warrants that they are the owner of the work, or if not, has the permission from the owner to exhibit the work at the gallery, on the terms set out in this contract.
The artist/s agrees to adhere to the Open Call’s entry requirements and entry process. Each Open Call will have it’s own individual requirements which will be displayed on the Nucleus Arts website when submission is open.
The artist/s agrees to deliver work to the specified location, during the specified time and on the specified date in the Open Call. Work that is not delivered on time will not be accepted for the exhibition.
The artist/s is responsible for any costs for transporting artwork to and from the exhibition space.
The artist/s agree to take away any packaging (unless stated otherwise) and to bring suitable packing upon collection.
The artist/s understands that the curators decision is final with regards to the layout of the exhibition.
Artworks will be hung using the Halpern Galleries hanging system - works without appropriate fixings will not be hung. See section ‘Standards of Presentation’ below for further details.
Halpern Galleries cannot take any responsibility for loss or damage to work as a result of poor fixings. We reserve the right to not hang works which have unsafe fixings.
The artist/s agrees to adhere to deadline for submission. Halpern Galleries cannot guarantee entry to late comers.
The artist/s permits their work to be photographed and used for marketing / evaluation purposes. Your work will be credited wherever used.
The artist/s agrees to collect work from the specified location, during the specified time and on the specified date in the Open Call. Halpern Galleries reserves the right to charge for storage of any unsold artwork(s) not removed from the premises by the collection date.
Halpern Galleries reserve the right to decline work that is deemed offensive or inappropriate to the specification of the Open Call.
Loss and Damage
The gallery assumes no responsibility for damage to or loss or destruction or theft of work from the time the work is delivered to/collected by the artist(s) to the gallery.
If in the period of the exhibition the work is lost, stolen, damaged, the gallery will not pay the artist(s) agreed selling price.
The gallery will immediately notify the artist(s) of any loss or damage to the work.
Insurance
Whilst the Nucleus Arts Public Liability Insurance covers the gallery space it is the choice of the artist(s) to take out insurance on their work.
Provision of Photographs, Slides, Digital Images
The gallery may use photographs of the work that are taken or supplied for permitted use as follows: reproduction in publicity material, exhibition catalogue or equivalent, Nucleus Arts website and/or social media sites, press/critical reviews, archival documentation for the gallery.
Sale of Work
The gallery is authorised to sell work on behalf of the artist(s) whilst on display at the gallery. All sales during the exhibition must be made through Nucleus Arts/Halpern Galleries. Private sales of work during the exhibition are strictly forbidden.
Halpern Galleries will take 25% commission on all sales in the Gallery (20% for Nucleus Arts studio artists & Creative Associates). The price of work given by the artist/s will be inclusive of that 25% (you will receive 75% of the price given should your work sell).
All sold artwork is to remain in the gallery until the closure of the exhibition unless otherwise agreed with Halpern Galleries prior to the exhibition opening.
Payment for work sold will only be made after all monies from customer/s purchasing artwork from the exhibition has been collected.
Exceptional Closure
Exhibitions are expected to remain open for the full exhibition space opening times inclusive of the dates outlined. The gallery is responsible for the control of the exhibition area, and retains the right to close the exhibition to the public where necessary.
The Gallery is closed on Sundays but reserves the right to open.
Environmental Requirements
Any special installation, maintenances or handling instructions are to be supplied by the artist(s) and is the artist(s) responsibility to do so.
Non-durable materials – if the work is constructed of any materials that are inherently non-durable or unstable, or if to change or decay is in any way an intended feature of the work, the gallery shall not attempt to prevent any deterioration or make good any damage to the work which is attributable to this.
Open Call Fees
Open Call submission fees contribute towards the total cost of gallery hire and are payable upon submission.
Submission fee payment does not guarantee acceptance to any Halpern Galleries exhibition unless stated otherwise in the Open Call.
Cancelling Your Submission
If an artist can no longer take part in any Halpern Gallery exhibition, Halpern Galleries will retain your submission fee.
Standards of Presentation
We require that all work hung in the gallery meets a high standard of presentation. This is in your interest as an exhibitor – work is more likely to sell if care and attention has been paid to its display.
No fittings of any kind may be attached to the walls - the fitted hanging system must be used.
The following stipulations must be observed:
All frames and canvases must be strung or fitted with sturdy D rings capable of supporting the weight of the work.
Strictly no clip-frames – they are not compatible with our hanging system.
Strictly no mirror plates - no work can be fixed into the walls.
All frames must be clean, sturdy and free from dents, scratches and other signs of wear.
All work must be labeled individually with the artist’s name, title, medium and price.
Halpern Galleries reserves the right to remove work from an exhibition if the standard of presentation does not meet with the requirements in this section.
